Under the terms of the nominee trust, the portion of the home that represented the wife’s inheritance was directed into her separate revocable living trust. Meanwhile, the balance of the equity in the home would be split equally between both spouses’ trusts, reflecting their mutual contributions to the household. One key element was ensuring that the surviving spouse would not be displaced. We made provisions for the surviving spouse to have the right to occupy the family home for the remainder of their life. Additionally, each spouse’s separate trust granted the surviving spouse a lifetime interest in the trust’s assets to cover their health, education, maintenance, and support (often referred to as HEMS). This ensured that no spouse would be left financially vulnerable, while also preserving the principal for each spouse’s respective children.

The Result

Through careful planning, we were able to resolve the couple’s concerns efficiently and effectively. The wife’s inheritance is now securely protected for her children, and both spouses have the peace of mind knowing that the surviving spouse will be taken care of without jeopardizing their individual legacies.
